The attorneys for former state Rep. Steve Nunn have asked a Fayette Circuit Court judge to release money from the sale of Nunn's home in Glasgow to pay legal fees, according to a motion filed Monday.
Nunn is charged with murder in the September shooting death of his former fiancée, Amanda Ross.
"It is imperative that the funds be released immediately so that counsel for defendant can retain the necessary experts to properly defend the criminal action," attorneys Warren Scoville and Hailey Scoville Bonham wrote in the motion.
Nunn transferred the deed to his home at 136 Fairway Place in Glasgow to The Scoville Firm PLLC on Oct. 16 to cover attorney fees of $200,000. The home sold at a Nov. 14 auction for $170,000, and the law firm was to receive net proceeds of $137,000.87.
But proceeds from the sale of the house and any personal property are in escrow "until further orders from the court," according to an agreed order for injunctive relief filed in a wrongful death lawsuit against Nunn. Ross's mother, Diana Ross, filed the lawsuit in late September.
According to the agreed order, Diana Ross raised objections to the house's sale, including that Nunn "fraudulently conveyed real property to The Scoville Firm and/or fraudulently conveyed personal property to Mary Nunn, Robert Nunn and/or Courtney Nunn."
Nunn's attorneys wrote in their motion that "there was never any secret" that Nunn would transfer his property to pay his law firm.
"This transaction was legal, above board, and opened to public scrutiny at all times," the motion states.
Nunn, 57, pleaded not guilty Nov. 19 to charges of murder and violating an emergency protective order. Ross, 29, was shot to death Sept. 11 outside her townhome in downtown Lexington.
Nunn also pleaded not guilty Nov. 17 in Hart County to six counts of wanton endangerment. He is accused of firing a .38-caliber pistol near six police officers, who approached him just hours after officers found Ross's body in the parking lot outside her home.
