The-theft by-deception case against former University of Kentucky basketball player Ed Davender has been delayed for a second time because he didn't have an attorney.
On Thursday, Davender appeared at Fayette District Court for a preliminary hearing on a charge that he took $4,000 from a Louisville man for NCAA Men's Final Four tickets he never produced.
Judge Megan Lake Thornton continued Thursday's hearing because Davender said he had not been able to secure a lawyer from jail.
Davender was taken into custody Aug. 27 after being sentenced in Fayette Circuit Court to eight years in prison on 19 counts of theft by deception and a drug charge. He was charged with the new count of theft by deception while on bond awaiting sentencing on those charges.
On Aug. 26, the first time Davender appeared without a lawyer, Thornton continued the case for two weeks. The judge said she was not unaware that the former UK player was being sentenced in Fayette Circuit Court the next day.
On Thursday, Thornton appointed the public defender's office to represent Davender but said she would allow the office to withdraw if Davender secured a private attorney before his next hearing, which is scheduled for Sept. 16.
