A Fayette County grand jury has decided not to indict the driver of a sport-utility vehicle that crashed into the Kohl's department store at Hamburg in July.

Whitney Lochmueller, 29, had pleaded not guilty in Fayette District Court to charges of driving under the influence, wanton endangerment and criminal mischief.

"The grand jury was presented all of the evidence. The defense also requested, under the rules of criminal procedure, to present evidence as well to the grand jury. That was done. Then they deliberated and chose not to indict," Fayette Commonwealth's Attorney Ray Larson said.

Lochmueller's attorney, Jim Lowry, had no comment about the grand jury's decision on Wednesday.

Police found a bottle of prescription pain relievers that was missing 23 pills in Lochmueller's vehicle. The prescription had been filled the day before the crash, according to court documents. The pain reliever, tramadol, can cause seizures, even in prescribed doses, according to makers of drugs that contain tramadol.

Lochmueller's 6-year-old twin siblings were in the sport-utility vehicle when it hit a Toyota occupied by Melissa and Richard McQueen and their 4-year-old son, then ran into the department store. The McQueens were treated at the scene. Lochmueller is the daughter of former University of Kentucky basketball player Steve Lochmueller.
