Harlan man shot, killed while trying to break into house

A Harlan County man was shot and killed late Wednesday while apparently trying to break into a house, according to state police.

The preliminary investigation indicates that Wayne Duff II, 37, of Cumberland, was trying to break into a house in the Gordon community of neighboring Letcher County, police said.’

James Brown, who was at the house, confronted Duff and the two got into an argument.

Duff made threatening remarks and started toward Brown, and Brown, who had a pistol, shot Duff in the chest, state police said.

Duff was pronounced dead at the scene.

The shooting happened about 11:15 p.m.

Police did not file any charges immediately, but will present evidence to a grand jury to see if the panel wants to indict Brown, according to the news release.
