Lexington police are awaiting toxicology test results on a driver involved in a fatal crash a week ago on Delong Road.

Charges against the driver could be possible depending on the test results, police spokeswoman Sherelle Roberts said Thursday.

Police said Jeremy Arvin was driving a Nissan 370Z on Delong Road about 10:30 p.m. on Jan. 4 when the car left the pavement and struck a tree.

A passenger, MacKenzie B. Hertweck, 21, died Tuesday night at University of Kentucky Chandler Hospital of brain injuries she suffered in the crash.

Police have said the car was traveling at high speed, and that alcohol use was suspected.

A decision on charges will be made once the test results are available, Roberts said. The tests could take a few weeks.
