Lexington police said a driver was under the influence of alcohol when he crashed a rented convertible into a fence post at Millcreek Elementary School in the middle of the day Tuesday.

A school employee who went to check on the driver found him slumped in the seat, snoring, just past noon, Lexington police spokeswoman Sherelle Roberts said.

The employee switched off the car's ignition and called police, Roberts said. Police charged Thomas J. Cross, 25, with DUI.

Cross was slurring his speech and unsteady on his feet when talking to officers, Roberts said. Police noticed a "strong odor of alcohol" coming from Cross and inside the vehicle, she said.

Officers found two empty 24-ounce cans of Icehouse Edge malt liquor in the car. A third can was mostly empty, Roberts said.

Cross was taken to the Fayette County jail.

Police said it appeared that Cross was trying to turn around in the school's parking lot after missing a turn on Appian Way. He apparently lost control of the car, which ran over a median, jumped a sidewalk and crashed into the fence.

Class was in session at the time. Millcreek Elementary is on Reva Ridge Way, off Appian Way.

Roberts said the car, a convertible Chrysler 200, had been rented by Cross's girlfriend. The woman had lent the car to Cross so he could visit a friend.
