Driver pleads not guilty to manslaughter in Lexington wreck that killed passenger

Second-degree manslaughter charges have been filed against a driver whose passenger died after a crash in January, Lexington police Lt. Raymond Roller said.

Jeremy Arvin, 23, also was charged with driving under the influence of drugs or alcohol. Arvin pleaded not guilty Monday in Fayette District Court.

MacKenzie B. Hertweck, 21, died Jan. 8, four days after the crash on Delong Road in Lexington.

An arrest warrant filed in Fayette District Court accuses Arvin of wantonly causing Hertweck's death by driving under the influence of drugs.

Arvin was driving a 2011 black Nissan 370Z that hit a tree. According to court records, Arvin was driving on Delong Road, approaching Tates Creek Road, at high speed when his car crashed into the tree.

Arvin refused to cooperate with an officer's request for a blood test, so a blood sample was obtained through a court order, the arrest warrant said.

Lab results confirmed the presence of marijuana in Arvin's system at the time of the crash, the warrant said.

Arvin was arrested Friday, according to court records. A preliminary hearing is scheduled April 30. Arvin's attorney, Raul Kazee, said Monday that it was too early to talk about the case.

Arvin was in the Fayette County jail Monday on a $55,000 cash bond, spokeswoman Jennifer Taylor said.
