Argument, apparently over ATV use, turns deadly for Owsley County property owner

BOONEVILLE — An Owsley County man died Saturday and a second man was shot after the two allegedly got into an argument involving an all-terrain vehicle.

Kentucky State Police were called at 8:14 p.m. Saturday to Seales Road in Owsley County by Andy Smith, 25, who had been shot. When they arrived at a home on Seales Road, they found Abner Gabbard, 71, dead, apparently from a gunshot wound.

Trooper Paul Blanton said Sunday that Smith told police Gabbard was upset because Smith was riding an all-terrain-type vehicle on or near Gabbard's property. Blanton said the two exchanged gunfire.

"We are investigating it as Gabbard and Smith shooting at each other," he said.

Smith was taken to the University of Kentucky Chandler Medical Center in Lexington for treatment. Blanton said that Smith had not been arrested and that the investigation was continuing.
