A Fayette grand jury will hear evidence against a man charged with raping a 13-year-old.

Rafael Arturo Ardon was arrested Dec. 13 on charges of second-degree rape and first-degree sexual abuse.

District Judge Julie Muth Goodman ordered the case sent to the grand jury after the defendant's attorney waived a preliminary hearing on Friday.

Goodman ruled that Ardon, who is in custody, can be released on a $1,000 full cash bond. She stipulated that he would have to wear an ankle monitor and be under home detention, able to go only to court or to his attorney's office.

Police allege that Ardon had sex with the victim at church and at his home. He held a "position of special trust/authority" over the victim, according to police.
