A Lexington man is facing charges in a fatal shooting in February.

Lamarius Gates, 20, was charged with complicity to commit murder Friday in the death of 23-year-old Vincenzo Happy on Feb. 9, police spokeswoman Sherelle Roberts said. Happy was shot while sitting in his car at a shopping center on Lima Drive. He died hours later at University of Kentucky Chandler Hospital.

Jayronn Montero Nickerson also is accused in the death of Happy; Nickerson is charged with murder and with being a persistent felon. Nickerson was indicted Tuesday and is being held in the Fayette County Detention Center on $505,000 bail.

According to court documents, Gates pleaded not guilty during arraignment Friday to receiving stolen property, tampering with physical evidence, failing to appear in court and various drug charges. He was being held in the Fayette County Detention Center. Gates is scheduled to be in court Monday on the murder charge.

Two weeks ago, Gates was cleared of charges in a shooting outside Shopper's Choice on Georgetown Street on June 30. The shooting was captured on surveillance video. No one has been arrested in that shooting, which was not fatal.
