A Lexington man has been charged in federal court with sending nude photographs of a 6-year-old child to an undercover detective. Cody Lee Herman, 27, sent the messages Monday night and was arrested early Tuesday, according to an affidavit filed in U.S. District Court.
The affidavit says Herman used an instant messaging application to correspond with an undercover detective with the District of Columbia Metropolitan Police Department who had placed an advertisement online in an attempt to “attract individuals with a sexual interest in children,” according to the document.
Herman began corresponding with the officer at 6:41 p.m. Monday. During the conversation, Herman discussed “sexually assaulting” the child and sent the detective a photo of the child’s genitalia, according to the affidavit.
An officer with the Federal Bureau of Investigation’s Child Exploitation Task Force, along with other FBI agents and Lexington police officers, executed a search warrant at Herman’s apartment on Lansill Road at about 3 a.m.
During questioning, Herman admitted to taking the photo of the child’s genitals and sending it to the detective using his iPhone, the FBI officer said in the affidavit.
