A ruling on Lexington native and Cleveland Indians outfielder Austin Kearns' DUI charge was delayed until next week, according to the Jessamine County District Court's office.
Kearns is seeking to have the charges dismissed because he claims the off-duty officer was outside his jurisdiction when he arrested him.
Kearns, 30, was arrested around 2:30 a.m. Feb. 12 by off-duty Lexington police officer Todd Hart on Golf Club Drive just off U.S. Highway 68 in Jessamine County.
Kearns refused to take field sobriety tests and later, at the Jessamine County jail, he refused to take a breath test to measure blood-alcohol content.

Kearns was charged with driving under the influence and failure to maintain required insurance and was later released on bond.
