Fayette Commonwealth's Attorney Ray Larson has been appointed by the Kentucky Attorney General's Office as the special prosecutor to handle the case involving the Sept. 13 shooting of a Lexington man in Madison County.
The attorney general's office and Larson said Tuesday that he will handle the case of Jesse Gibbons, 29, who was shot by police off the Eastern Bypass in Richmond.
In December, Kentucky State Police turned over the investigation results to Madison County Commonwealth's Attorney David Smith, who recused himself because of conflicts of interest. Larson said he is reviewing the investigative file. It will be up to him to determine whether a Madison County grand jury hears evidence about the case.
Gibbons allegedly assaulted Lexington police officer James Winter at the Circle K in Buckhorn Plaza in Lexington, then fled. Lexington police chased him to Richmond. There, according to state police, Gibbons lost control of his vehicle and crashed into a wooded area on the bypass, where he was shot. Names of the officers involved in the shooting have not been released.
