The widow of a miner who died in an underground accident in Leslie County has filed a wrongful death suit against the mine company.
Pamela Brock of Helton, represented by Lexington attorney Tony Oppegard, filed suit Wednesday in Leslie Circuit Court. She is seeking damages for herself and her son, Travis Jager Brock, 4, for loss of consortium, loss of future wages and punitive damages.
Travis Brock, 29, died Jan. 22, 2010, after being crushed by a 9.3-ton rock that fell from a mine wall in the Abner Branch Rider mine, owned by Bledsoe Coal Corp. and James River Coal Co. Brock was operating a continuous miner machine.
The federal Mine Safety and Health Administration cited the mine after the collapse and had cited it previously for failing to maintain and follow a roof control plan to prevent collapses.
The company, whose headquarters is in Richmond, Va., did not return a call seeking comment.
