A Madison County grand jury determined Wednesday that a police officer was justified in the fatal shooting of a suspect during an attempted robbery on Jan. 22.
The grand jury found that Richmond Officer Kelly Rouse was justified in using deadly physical force in shooting Michael McMullen, 39, of Lexington, said Commonwealth's Attorney David Smith.
McMullen had pointed a handgun at Rouse inside a Kentucky Fried Chicken on the Eastern Bypass in Richmond.
Smith said there was never any allegation that Rouse did anything wrong. However, it has been the practice of law enforcement agencies in Madison to have an investigation in such cases presented to a grand jury, Smith said.
Kentucky State Police had investigated the shooting.
