A judge decided one juror's failure to pay child support 24 years ago was enough to grant Paul Laurence Dunbar High School graduate and former University of Kentucky student Shayna Hubers a new trial in the killing of her boyfriend.
Campbell County Circuit Court Judge Fred Stine ruled on Thursday she will get a new trial because juror David Craig served on the jury despite being convicted of a felony for failure to pay child support in 1992.
In his ruling, he stated he has no choice but to follow the state law. While federal law requires a defendant to show the results of the trial would be different, Kentucky law allows any "good cause" challenge to disqualify a juror. Stine sentenced Hubers last August to 40 years in prison for killing 29-year-old Ryan Poston in his Highland Heights home.
