A committee of the Lexington Urban County Council members investigating an employee's fraud allegations want the details of those allegations by Wednesday — even though they've been previously deemed off-limits to individual council members and not subject to the state's Open Records Act.
Still, if the administration's internal audit division does not hand them over, they can expect to get a subpoena, committee members decided Monday.
"If you don't get (the documents), you enforce the powers the council has to demand them," said the committee's newly hired council, retired Franklin Circuit Judge Roger L. Crittenden.
Once those crucial documents are in hand, committee members will discuss other records and witnesses they want to request.
The fraud allegation surveys — routine questionnaires filled out by city employees as part of audits — are key to the committee's work. Patrick Johnston, the director of risk management, made the allegations in 2008 and 2009; in both years, external and internal auditors found them to have no foundation.
In the meantime, however, Johnston's job has been marked for elimination, and he and others have said they think the two issues are related.
Committee chairman George Myers said the fraud surveys will be kept in the council clerk's office where committee members may read them and take notes. No copies will be made.
A series of e-mails from 2007 show Johnston questioning the integrity of the city's insurance procurement. That's an issue that State Auditor Crit Luallen is looking at in a separate investigation, one that will also question Johnston's allegations.
The committee also changed its meeting dates in order to meet with Crittenden. The committee will now meet on at 9 a.m. June 22, 8 a.m. June 29, and 3 p.m. June 30 and July 1.
The committee appointed Crittenden on Monday.
