Attorney General Andy Beshear sued a Lexington home improvement business Wednesday, seeking civil fines and refunds for customers who were allegedly wronged.
Beshear announced at a Capitol news conference that his office has filed a consumer protection lawsuit against American Home Design Inc., which does business as Sunrooms and More LLC, and owner Jerod Hagen.
The suit filed in Fayette County Circuit Court also names Sunrooms and More NKY LLC and Sunrooms and More Louisville LLC as defendants. The principal office location of each defendant is listed as 163 Old Todds Road in Lexington.
Hagen was not immediately available for comment. Neither was the business’ attorney, Joshua T. Rose of Louisville.
Beshear said the defendants provide a wide range of home remodeling services in Central and Northern Kentucky and specialize in sunroom additions.
Beshear said his office reviewed more than 70 consumer complaints over three years against the defendants. He said it issued a civil investigative demand for information in March and the defendants provided only a partial response to the request.
That prompted him to seek penalties for violation of Kentucky’s Consumer Protection Act.
Beshear’s lawsuit claims on numerous occasions the defendants did not obtain building permits, failed to perform or complete work, and failed to remedy defective work. The defendants also misrepresented their products to customers and refused to honor valid cancellation notices under state law, he said.
Beshear is asking a judge to order the defendants to fully respond to his office, provide restitution for consumers, correct sales and contractual practices, and prevent future violations or risk the withdrawal of their certificate to do business in Kentucky.
Beshear said it was too early to say what the size of any fines might be.
Customers who have been wronged by the defendants and have not already filed a complaint with either the Office of the Attorney General or the Better Business Bureau should file a report with the Attorney General’s Office of Consumer Protection. Complaints may be filed online at ag.ky.gov.
Beshear said consumers may be able to avoid falling victim to deceitful business owners if they research business reviews online before making a purchase or signing a contract.
