Kirk was indicted by a federal grand jury in November on possession of child pornography charges, and was later charged with an additional count of producing child pornography.
Assistant U.S. Attorney Erin May said she will recommend during sentencing that the possession charge be dismissed.
Kirk will be sentenced on Oct. 2. He faces a maximum sentence of 30 years in prison and a minimum of 15 years.
