Harlan man charged in car-ATV wreck

A Harlan County man was charged Tuesday with first-degree assault and a third offense of driving under the influence after a collision between the car he was driving and an ATV operated by a juvenile, state police said.

Jeffrey W. Massengale, 53, of Evarts, was lodged in the Harlan County Detention Center. The juvenile, whose name was not released, was airlifted to Holston Valley Hospital in Kingsport, Tenn.

The collision was reported at 5:20 p.m. Tuesday on Ky. 38 near Evarts, state police said. The juvenile was headed west on Ky. 38, and a Toyota Corolla driven by Massengale was traveling behind it.

The juvenile gave a hand signal and proceeded to make a left turn, but the Corolla crossed the center line to overtake the ATV and struck the ATV on the right, police said. The ATV overturned, and the Corolla ran off the road and struck a tree.

Massengale was also charged with possession of an open beverage in a vehicle and possession of a controlled substance, police said. He was still in jail Wednesday night in lieu of a $100,000 full cash bond.
