The Sierra Club has sued East Kentucky Power Cooperative, alleging that a new boiler at the Hugh L. Spurlock coal-fired power plant near Maysville was built without modern controls on mercury and other emissions.
The suit, filed in U.S. District Court in Lexington, says the boiler did not undergo a key test to show it met the maximum achievable pollution reductions.
Nick Comer, an East Kentucky Power spokesman, said the unit complied with all applicable permits, and that the company "intends to vigorously defend itself in this lawsuit."
