The man accused of killing another man in early at the Augusta Arms Apartments was indicted Tuesday on charges of murder and robbery, according to court documents.
Timothy Lynn Fogle, 40, of Louisville was arrested Aug. 5 at the transit center in downtown Lexington just over an hour after police obtained a warrant for his arrest.
Fogle is accused of killing Theodore Custard, 55, with a knife on Aug. 3 or 4, according to court documents. Custard was found dead inside the apartment on Aug. 4.
Fogle also is charged in a robbery that occurred about three days before Custard’s death. He is scheduled to be arraigned Oct. 12 in Fayette Circuit Court, according to court documents.
