Court case against Fortune Hi-Tech Marketing moved to Kentucky
The federal court case against a Lexington company accused of operating an illegal pyramid scheme has been moved from Illinois to Kentucky.
U.S. District Judge John W. Darrah of the Northern Illinois District issued an order Friday moving the case against Fortune Hi-Tech Marketing to U.S. District Court for the Eastern District of Kentucky in Lexington. The case is now before U.S. Judge Karl Forrester, according to court documents.
The case against Fortune Hi-Tech was brought by the Federal Trade Commission and the attorneys general of Kentucky, Illinois and North Carolina. Federal and state officials shut down the company in January, closing its offices in Lexington and Danville.
The case was filed in federal court in Chicago, home of the Federal Trade Commission regional office handling the case.
In his order, Darrah concluded that the alleged victims in the matter are nationwide and that decisions regarding the business were made in Kentucky. The judge also considered convenience and the potential speed of future proceedings, noting that all the defendants and one of the plaintiffs are in Kentucky.
