Charges added for 2 accused in man’s Lexington death. Body was discarded miles away.
The men accused of killing a 57-year-old in Lexington and driving his body to a wooded area in Washington County have been indicted, and both now face additional charges.
Anthony Asay, 18, was charged with murder and evidence tampering in the death of Donald “Don” Foster. This week, he was indicted on those counts and an additional charge of abuse of a corpse, according to court records.
Dillon Stewart, 19, was initially charged only with evidence tampering, but he’s now also been indicted on charges of murder and abuse of a corpse, according to court records.
The investigation began in December when Lexington police received a tip that took them to an apartment on Augusta Court. They were let into the apartment by a maintenance worker and found evidence of a struggle and signs that someone had suffered a traumatic injury, according to court records.
Stewart and Asay had been recently evicted from the apartment, police learned.
In a later interview with investigators, Stewart said that Asay had killed Foster when Foster came to the apartment to sell some fuses, according to court records.
Stewart told police he’d seen Asay go into a room with Foster and close the door before hearing a struggle, according to court records.
When Asay came back out of the room, he told Stewart he’d killed Foster, a detective testified in January. The detective also said during that hearing that Foster and Asay had been in an ongoing dispute.
After Foster was killed, Asay and Stewart drove his body to a remote area of Washington County, according to court records.
Stewart and Asay were taken into police custody in Jessamine County on Jan. 1. Stewart eventually gave police enough information for them to be able to find Foster’s body, according to court records.
The truck used to move Foster’s body was found — along with a crowbar that had been mentioned in interviews — in a Louisa salvage yard, the detective said in the January court hearing.
Stewart and Asay are set to be arraigned in Fayette County Circuit Court on March 12, according to court records.
