A Kentucky man has been arrested after he overturned his vehicle into a flooded creek while driving drunk, killing a passenger who was a child, police said.

The crash happened Saturday night, June 27, in a creek near Bewley Hollow Road in Hardin County. Kentucky State Police said David Rhodes, 44, of Elizabethtown, lost control of the vehicle on Bewley Hollow Road and rolled over into a flooded creek, trapping Rhodes and two juvenile passengers inside.

State police trooper Tyler Walters, a Hardin County Sheriff’s Office deputy and the Hardin County Emergency Management Coordinator responded to the scene and rescued Rhodes and the juveniles. State police said all three were taken to Baptist Health Hardin in Elizabethtown, but one of the children was transferred to Norton Children’s Hospital in Louisville, where they died Sunday.

The other child and Rhodes suffered minor injuries, and have since been released from Baptist Health Hardin. State police did not provide the identity of the passenger who died.

Rhodes has been charged with DUI and first-degree assault. State police said additional charges are forthcoming.

Rhodes is being held at the Hardin County Detention Center. Jail records indicate he will make a virtual court appearance Monday morning in Hardin County District Court.
