Third suspect's case in fatal shooting in Lexington goes to grand jury

The case of a Lexington man accused of helping to dispose of a gun used in a fatal shooting was waived Tuesday to a Fayette County grand jury.

Johnie Carlisle "Trey" White III, 20, has pleaded not guilty to a charge of tampering with evidence for allegedly helping Trustin Jones, 20, dispose of a gun used to shoot Derek Pelphrey, 23.

Pelphrey was shot in the neck Sept. 3 as he sat in his car on Ridgepoint Run Road near Spangler Drive.

During a preliminary hearing on Monday for Jones, a Lexington police detective testified that the murder weapon was thought to be a .22-caliber Smith & Wesson pistol.

Police have not found the gun, which they were told was discarded in a tributary of the Kentucky River near the Fayette-Clark County line.

White also faces several charges stemming from other cases, including assault, wanton endangerment, carrying a concealed deadly weapon, drug trafficking and drug possession.

The case against Jones and another co-defendant, Robert Guernsey, 32, who is charged with complicity to murder, were waived to a grand jury Monday.
