18-year-old says she got out of DUI, but Colorado deputy’s video tells another story
An 18-year-old woman said she got out of a DUI in Colorado after blowing a “3.8” in blood alcohol concentration , a video shows.
The woman also said the deputy left his number with her on a card and asked her out to lunch and coffee, in a video posted on Twitter on April 3.
“I got out of a DUI and got let off with a warning. That officer deserves a raise,” she is heard saying in the video as she laughs.
The legal limit for BAC in Colorado is .08%. Death would be possible for a person at a BAC of .40%.
But the Jefferson County Sheriff’s Office posted the deputy’s body camera, and it tells a different story.
A deputy pulled the woman over for weaving, the deputy is heard saying in the video when he first approaches her car. He pulls her over around 4:41 a.m. on April 2.
The 18-year-old then starts to cry and tells the deputy she and her boyfriend had broken up.
He asks her if she was on the phone while she was driving and she said she was trying to contact her ex-boyfriend, the video shows.
The deputy then asks the woman if she had been drinking, and she said no. He got her license and registration and returned back to her car to give her a warning, the video shows.
“Sounds like you are having a rough night, so I am not going to add to that by writing you a ticket or anything,” the deputy says.
He hands her a business card that includes his badge number, name and the reason he pulled her over, the sheriff’s department said in a news release. That card didn’t include the deputy’s phone number.
The video from the deputy’s body camera also didn’t show the deputy conducting any DUI tests.
“She also did not slur her speech, nor did the deputy smell alcohol on her or witness any other physical signs of intoxication. There was no evidence of alcohol in the vehicle,” the department said.
