Man accused in Nicholasville fatal shooting not facing charges, police say

The man accused of shooting two people, killing one, at a Nicholasville apartment complex earlier this week will not immediately face charges, police said in a news release Friday.

The shooting happened around 9:30 a.m. Thursday at an apartment building on Edgewood Drive. Nicholasville police said James Milton, 31, was shot at least twice in the chest, while his mother, Samantha Milton, was inadvertently shot in the arm.

Both were taken to University of Kentucky Chandler Hospital, where James Milton was later pronounced dead, according to police. Samantha Milton was treated and released.

Police identified the shooter as Raekwon Scott, 24. He remained at the apartment building after the shooting and cooperated with authorities, the department said.

A preliminary investigation indicates James Milton saw his girlfriend enter Scott’s apartment and attempted to break in by kicking in the door, police said. Both men live in the same apartment building.

Police said Samantha Milton was at the apartment with her son, who was in a “prolonged verbal dispute” with his girlfriend the prior evening.

James Milton was reportedly leaving when he saw his girlfriend enter Scott’s apartment. Police said Scott, armed with a handgun, opened fire while James Milton attempted to break in, striking the man and his mother.

An autopsy on Milton’s body was conducted at the State Medical Examiner’s Office on Friday, according to the Fayette County Coroner’s Office.

In the Friday news release, police said interviews and a search of Scott’s apartment supported his account of the shooting. Scott has not been criminally charged, but the investigation is ongoing.

“An analysis of evidence and continued consultation with the Commonwealth Attorney’s Office will ultimately determine culpability,” Nicholasville police said.
